YOU AND PARENT STACK AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. Neither party may bring claims as a plaintiff or class member in any class action, consolidated action, or representative action.

This class action waiver is an essential part of this arbitration agreement. If the class action waiver is found unenforceable, the entire arbitration agreement is void.

Exceptions to Arbitration

The following may be brought in court:

Claims in small claims court within jurisdictional limits
Claims seeking injunctive relief for intellectual property infringement
Claims to enforce arbitration awards

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law provisions.

Jurisdiction and Venue

If arbitration does not apply, you agree to submit to the exclusive jurisdiction of courts located in Victoria, Australia, and you waive any objection to venue or inconvenient forum.
